Non-payment of rent in Spain is not so easily rectified as it is in the U.K.
To begin with, so long as you get your property back eviction proceedings are generally considered to be an acceptance and condonement of the debt owed in rental!
You can claim for lost rental but to do so you
must first have issued a formal request for payment due prior to
starting legal proceedings.
Claims for under 900€ do not require a
lawyer and court procurator and are heard under the so called
´verbal´court case proceedure (now you would need a lawyer to explain
that!)
If the owner of the property does agree to waiver the claim for overdue monies this makes the proceedure to recover the property more rapid.
The compromise made by the landlord should be stated in the court petition.
The pardoning of the debt is subject to the tenant vacating the property voluntarily within a specified period which will be not less than one month after being served notice.
